The Fla-Vor-Ice Friends Wanted Promotion (the “Promotion”) starts on July 12th, 2011 at 12:00 a.m. Eastern Time (“ET”) and ends on August 10th, 2011 at 11:59 p.m. ET (“Promotion Period”). The Promotion will be divided into thirty (30) daily prize periods (each, a “Daily Prize Period”). For the purposes of this Promotion, each Daily Prize Period will begin at 12:00 a.m. ET and end at 11:59 p.m. ET that same day.

ELIGIBILITY: Promotion is open to legal residents of the fifty (50) United States and the District of Columbia, who are 13 years of age or older. Eligible minors should obtain their parent or legal guardians permission prior to participating. Employees of The Jel Sert Company (“Sponsor”), Kremsa Design, Inc. (“Agency”) and their respective parents, subsidiaries, affiliates, promotion and advertising agencies, and members of their immediate family (spouse and parent, children and siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible to enter or win. Void where prohibited by law. Promotion is subject to all applicable federal, state and local laws. This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. You understand that you are providing your information to Sponsor and not to Facebook. The information you provide will only be used for Promotion purposes.

HOW TO PARTICIPATE: During the Promotion Period, be a fan of the Fla-Vor-Ice Facebook page at http://www.facebook.com/flavorice and follow the instructions provided to complete the online registration form to receive one (1) Grand Prize drawing entry and one (1) Daily Prize Period point. All entries must be received by 11:59 p.m. ET on August 10th, 2011 to be considered for the Grand Prize drawing and points must be received by 11:59 p.m. ET to count towards the applicable Daily Prize Period. To receive additional points for the Daily Prize Periods: Once you have submitted an entry, you can follow the directions to send invites, post, tweet, and forward messages to your friends about the Promotion which will include a unique link. You will receive ten (10) additional points for each unique friend that clicks your link and is a fan of the Fla-Vor-Ice page. There is no limit to the number of points you receive. You may not receive a point from the same friend more than once in the same day. Entries or points generated by script, macro or other automated means and entries by any means which subvert the entry process are void. Limit twenty (20) entries per person, per e-mail address and per household per day for the duration of the Promotion Period. Multiple Entries received from any person or e-mail address or household in excess of the limitation stated above will be void. All entries become the sole property of the Sponsor and will not be returned.   

GRAND PRIZE RANDOM DRAWING: One (1) potential Grand Prize winner will be selected in a random drawing held on or about August 11th, 2011 from all eligible entries received throughout the Promotion Period. Odds of winning depend on the number of eligible entries received throughout the Promotion Period.

DAILY PRIZE PERIOD WINNER SELECTION: Potential Daily Prize winners will be determined by Agency, an independent judging agency based on the number of points received by each participant upon the completion of each applicable Daily Prize Period. The individual with the highest number of points for each Daily Prize Period will be deemed a potential Daily Prize Period winner. In the event of a tie, judging agency will select a winner. Odds of winning a Daily Prize depend on the number of points received by participating individuals for each applicable Daily Prize Period. Points received by participants for one Daily Prize Period drawing will not carry over into other subsequent Daily Prize Period point totals.

WINNER NOTIFICATION: Sponsor’s decisions are final and binding on all matters relating to this Promotion. Potential Grand Prize winner will be notified via phone, email and/or mail on or about 24 hours after the end of the selection and will be sent an Affidavit of Eligibility/Compliance and Publicity/Liability Release forms (unless prohibited by law). Potential Grand Prize winner must have all documents completed, signed, notarized and returned within 10 days. Potential Daily Prize winners will be notified via email and will have their prize shipped within 4 to 6 weeks. Return of prize or prize notification as undeliverable, failure to sign and return requested documentation within the specified time period, the inability of Sponsor to contact potential winner within a reasonable time period or noncompliance with these Official Rules will result in disqualification and, at Sponsor’s sole discretion; prize may be awarded to an alternate. If any potential winner is an eligible minor, prize will be awarded in the name of his/her parent or legal guardian, and such parent or legal guardian will be required to fulfill all requirements imposed on winners set forth herein.

GRAND PRIZE (1): A $2,000 Visa gift card. Approximate Retail Value (“ARV”) is $2,000.

DAILY PRIZES (30) (One (1) per Daily Entry Period): Coupons of free Fla-Vor-Ice Product. ARV: $46 each.

PRIZE CONDITIONS: Gift card subject to certain terms and conditions as specified by issuer. All federal, state and local taxes and all other costs associated with prize acceptance and use not specified herein as being provided. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Winners may not substitute, assign or transfer prize or redeem prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute prize (or portion thereof) with one of comparable or greater value.

GENERAL CONDITIONS:  By participating, each entrant agrees: (a) to abide by these Official Rules and decisions of Sponsor, which shall be final and binding in all respects relating to this Promotion; (b) to release, discharge and hold harmless Sponsor, Kremsa Design, Inc. and their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Promotion or any Promotion-related activity or the acceptance, possession, use or misuse of any prize; and (c) to the use of his/her name, voice, performance, photograph, caption, entry, and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor and its designees, without compensation (unless prohibited by law) or additional consents from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use.

MISCELLANEOUS: Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, or garbled entries or points, or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Promotion, the processing of entries or points, the announcement of the prizes, or in any Promotion-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion.  Released Parties are not responsible for injury or damage to any person's computer related to or resulting from participating in this Promotion or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Promotion or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Should any portion of the Promotion be, in Sponsor’s sole opinion, compromised for any reason, including virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of Entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Promotion (or portion thereof) and, if terminated, at its discretion, select the potential winner(s) for the Grand Prize drawing or Daily Prize Period(s) at issue from among all non-suspect, eligible entries received for the applicable Grand Prize drawing or Daily Prize Period(s) prior to action taken. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
